T&C - Expertville

General Terms and Conditions Expertville FZ LLC.

The present general terms and conditions (hereinafter: “GTC”) shall regulate and specify the conditions of the registration made by the Users on the website located at http://www.expertville.co hereinafter: “Website”) and its subdomains operated by Expertville FZ LLT (hereinafter: “Expertville”, “Service Provider” or “Company”).

Expertville also provides an Application which allows the Users to schedule the online Classes.

Expertville provides the Users with the use of the Platform, including English Classes in return for payment (hereinafter: “Payment”), and the Users are able to choose from multiple Payment Constructions according to their preferences.

Accepting the present GTC, and the privacy policy of Expertville(hereinafter: “Policy”) is a prerequisite for purchasing a Package.

Definitions

The following capitalized terms shall have the following meanings in the present GTC.

GTC: shall mean the present general terms and conditions of Expertville.

Class: shall mean an online individual or group class held for the User to study English by a Teacher on the Platform.

Chat Service: means the virtual chat service available on the Website for the Users, which allows the Users to communicate with the Service Provider online.

Contract: means a specific contract concluded between the Service Provider and the User for the use of the Services.

1-on-1: means a virtual class held by one Teacher for one Student.

Group Class: means a virtual class held by one Teacher for multiple Students, who each purchased a group class.

Student: any natural person who attends the Classes provided on the Platform.

Teacher/Tutor: means a natural person who is in a contractual relationship with Expertville and teaches English for the Students via the Platform.

Trial Class: means the first practice lesson, when the Student’s English language knowledge is determined, furthermore the Student and User are familiarized with the Platform.

User: any natural person who enters into a legal relationship with the Service Provider for the provision of the Services under the terms of the present GTC.

User Account: shall mean a personal page of a registered User on the Platform, which has a client part accessible to all Users and an administrative part with information of the owner of the Personal Account, concealed from other users of the Platform.

Website: means the website located at www.expertville.co operated by Expertville and all subdomains thereto through which Expertville provides the Services, including the Platform.

Package Subscription: Paying in advance for a specified number of classes as a bundle under our Packages page.

THE CLASSES

Trial Class

Before purchasing a Payment Construction, will hold a Trial Class for the User upon the User’s request. Trial Classes are aimed to familiarize the Student and the User with the Platform, as well as to determine the level of English proficiency of the Student.

Completing a Trial Class is not a prerequisite for beginning the Classes, however without a prior assessment of the English language knowledge of the Student, he or she may only begin with the introductory level. The completion of the Trial Class is mandatory for the Student to begin learning at a higher level.

The Teacher of the Trial Class is selected by Expertville, and is not subject of the decision of the User.

The User is permitted to postpone or cancel a Trial Class not later than 24 that is twenty four hours before the start of the Trial Class. The User’s failure to meet this specified deadline shall mean that the User agrees to the time of Trial Class. If at the time set for starting the Trial Class the User is unavailable within the initial 5 that is five minutes, the Teacher may stop waiting for the User, and the Trial Class shall be considered to have been held. In this case, Expertville may refuse to hold a repeated Trial Class for the User.

Enrollment

Expertville reserves the right to reject applicants without disclosing reason.

Classes shall not take place before payment is successfully processed.

Prices are subject to change affecting only unpaid services/courses/sessions.

Scheduling the Classes

The User selects available time slots and is matched with a Teacher based on availability.

Expertville is entitled to reserve time in a Teacher’s schedule for Users with a Package Subscription. However, if the User fails to pay the Subscription 24, that is twenty-four hours before the start of the Class, the reservation shall be cancelled.

1-on-1 classes are scheduled by User/Student.

Group Classes are set by Expertville and Users are notified upon completion of group.

Payment system

Users are required to pay the total purchase price of the Payment Construction in order to participate in Classes. Users are able to pay the purchase price with providing the credentials of their credit or debit card or their PayPal account.

For the Users to be able to pay with debit or credit card, Expertville uses the services of Stripe and accepts the following types of credit cards:

VISA
MasterCard

The User may not request Expertville to change the Teacher unless there is a misconduct on the part of the Teacher, in which case Expertville shall conduct thorough investigation and review class recording to determine and resolve the issue in the best way Expertville sees fit. The Service Provider reserves the right to refuse such request of the User. In case the User refuses to take the Classes with the provided Teacher, the Student may discontinue to attend the classes however, no refund will be processed.

In all cases, the payment process related to the purchasing of the Payment Construction is processed by Stripe as a third-party payment processor, depending on the payment method chosen by the User for purchase which means the User shall be bound by the terms of that third-party payment processor. User shall bare any payment processing rate fee where applicable.

Procedure of the Classes

The Class’s starting time shall be the starting time set in the Class Schedule notified to User or reflecting on the platform. The User is able to join a Class via the Platform link/Url link sent via email at the starting time of the Class by clicking on the “Join Space” button or link assigned. In order to start the Class, both the Teacher and the Student shall be present in the virtual classroom.

Note: 25 minute classes are booked as 30-minute slots on our platform, however, class duration will only be for 25 minute with a start time of o’clock or half past. For example: class starting at 2:00 shall end at 2:25 and a class starting at 2:30 shall end at 2:55.

Only the presence of the Student is mandatory during the Classes, however Service Provider advices the User to be present at the Classes for the first 3 or 4 Classes of the Student to help the Student to get familiar with the interface of the Platform as well as the Teacher.

The Classes shall be held in English language, and the Teacher is prohibited to use any other language during the Class, except when the User or the Student faces technical difficulties.

Recommended technical requirements to participate in the Classes:

Operating system: Windows 8/8.1/10, Mac OS 10.10, 10.11; for tablets: Android or iOS system;
The latest stable user version of the Google Chrome Browser installed, with the setting of automatic update enabled;
RAM: 4 GB and higher;
CPU: dual-core processor, min. 2.2 GHz;
A working microphone and camera;
Internet connection: min. 35 Mbit/s.

For participating in Classes, the User shall allow access to microphone and camera on his or her device.

The User acknowledges that Expertville will record a video of the Classes for the purpose of controlling the quality of the Services that Expertville provides and for the purpose of investigating the claims of the User, furthermore to make the Student and the User able to re-watch and repeat a lesson.

Therewith, the User agrees that specific video records may in some cases be submitted to the Teacher, Expertville, any of its subsidiaries , state authorities or courts subject to legal grounds for such submission.

Cancellation and Postponement of Classes

Cancellation and postponement of the Classes by the User without a loss of Balance may be arranged not later than 24, that is twenty four hours before the start of the Class. The User’s failure to meet this deadline shall mean that the User agrees to the proposed time of the Class, and if the Student is absent on such Class, Payment for it shall not be refunded to the User.

Termination of Service

Expertville reserves the right to immediately and without prior notice terminate services without refunding incase of one or any of the following acts are detected: sharing of contact information with Tutor or attendees, verbal harassment, cyber bullying, nudity, racism, politics, religion, hate, violence, use of profanities, disrespect of Tutor and other attendees at all times.

Absence from the Classes

If the Student is absent from the Class on the Platform at the starting time scheduled for it, the Teacher shall wait for the Student for 10, that is ten minutes. If the Student fails to start the Class in this timeframe, or if the User fails to notify the Service Provider in advance [72 hours ahead] of the Student’s inability to attend the Class, this Class shall be considered to have been held and shall be written off from the Balance of the User. If the Student enters the Class during this mentioned timeframe Teacher will start the Class as usual however, when the time is up, the Class will end immediately regardless the amount of material covered. This Class will be considered as completed.

Classes that have not been held due to the Teacher’s fault shall be subject to free cancellation (without writing it off from the User’s Balance) or shall be postponed to another time convenient for the User.

Students are encouraged to join class 3 minutes prior to class start time.

Refunds

As we are using a third party payment gate way transaction service fees are nonrefundable. Any refunds issued shall reflect on original payment method within 5-10 business days.

Refunds are only issued incase of the following conditions:

For packages, refund shall be processed upon request given that the Student attended a maximum of 2 classes and requested the refund within 5 days of the payment. Refund will be for the remaining unused classes on the condition that the request is raised at least 72 hours prior to the start of the next class.
In case of emergencies, Expertville holds at its discretion the right to evaluate each case separately and decide if a refund will be issued.
Shall a Student be banned for violating the term and conditions, no refund shall be issued.

Trial classes are nonrefundable.

INTELLECTUAL PROPERTY

By accepting this GTC, the User acknowledges that the Services, including, but not limited to, logo, data, information, pictures, texts, music, audio contents, any other contents, illustrations, user interfaces, audio and video clips, editorial content, as well as scripts and software used for the implementation of Services, contain such proprietary information and material the right holders of which is Expertville, and which are protected by applicable intellectual property or other legislation, including, but not limited to, copyright protection. The User accepts that they may not use such proprietary information or contents in any other manner than the private, non-commercial use of the Services set out in this GTC. It is prohibited to reproduce any part of the Services in any form or by any means unless expressly permitted by this GTC. The User acknowledges, that he or she may not, in any way, modify, let, sell or distribute the Services or the Application or any part thereof, and he or she shall not be entitled to use the Service in any manner expressly not permitted.

Safety

Please note the Expertville is using third party providers for payments and virtual classrooms, thus, shall any disputes arise Expertville shall not be held responsible.
